Electronic Records and Signatures Consent

1. Introduction

This Electronic Records and Signatures Consent (this “E-Sign Consent”) applies to all agreements, disclosures, notices, statements, and other communications (“Communications”) relating to the Billion application, website, non-custodial wallet, payment card, and related services (the “Services”). Capitalized terms not defined here have the meaning given in our Terms of Use.

2. Consent to Electronic Records and Signatures

By accepting this E-Sign Consent, you agree that Billion and its partners may provide you with all Communications in electronic form, and that electronic Communications and signatures satisfy any legal requirement that such Communications be in writing or signed. Your electronic acceptance (for example, clicking “I agree”) is legally binding and has the same effect as a handwritten signature.

3. Communications Covered

Communications covered by this consent include these Terms of Use, the Privacy Policy, the Risk Disclosure, this E-Sign Consent, transaction confirmations and statements, and legal, regulatory, and service notices. Communications relating to the Card are provided by our licensed partners and may also be subject to the partner’s own electronic-communications terms and disclosures.

4. How We Provide Communications

We may provide Communications by posting them in the Billion application or on our website, by email, or by other electronic means. It is your responsibility to review Communications and to keep your contact details current (see Section 8).

5. Hardware and Software Requirements

To access and retain electronic Communications, you need:

• a current web browser or the Billion application;
• a device with internet access;
• a valid email address;
• software to view and save PDF or similar documents; and
• the ability to store or print Communications for your records.

6. Requesting Paper Copies

You may request a paper copy of any Communication by contacting us at [email protected]. We may charge a reasonable fee for paper copies where permitted by law.

7. Withdrawing Consent

You may withdraw your consent to receive Communications electronically at any time by contacting us at [email protected]. Withdrawing your consent may delay or prevent your use of the Services, including the Card, which require electronic delivery.

8. Updating Your Contact Information

You are responsible for keeping your email address and contact details current in the Billion application or by contacting us at [email protected]. We are not responsible for Communications not received because your contact details were out of date.

9. Acceptance

By clicking “I agree” or otherwise accepting this E-Sign Consent, you confirm that you are able to access electronic Communications, that you meet the requirements above, and that you consent to receive Communications electronically as described here.
